Section 72 enables a commercial landlord to use Schedule 12 (taking control of goods) of the TCE Act to recover rent payable under the lease from the tenant, without needing to go to court.

Under CRAR, only Certificated Enforcement Agents  are permitted to seize goods belonging to the tenant to recover rent arrears.

High Court Enforcement Officers can execute:

A High Court Judgment in England and Wales, this includes a High Court Writ. Additionally this can include writs of:

  • A County Court Judgment (CCJ) for a value of £600 and above, which has been transferred up to the High Court for enforcement.

  • Possession, Possession and Control, Restitution, Delivery and of Assistance

  • A High Court Possession Order or County Court Possession order transferred to the High Court for Enforcement

  • An Employment Tribunal or ACAS Award

Council Tax & Business Rates
Council Tax & Business Rates

Councils instruct an enforcement agent to collect an unpaid council tax or business rates debt from debtors if a liability order has been issued in their name. The council will only do this if the debtor has not been in contact and arranged repayment or broken an arrangement.

Before the Council Tax debt is passed over to an enforcement agent, they will send a letter informing the debtor of the costs that will be incurred.

This will then go through to a compliance stage where the enforcement agent will send a Notice of Enforcement, which is the catalyst leading onto the enforcement stage.
